Welcome to the Guestify Platform!
Thank you for using Guestify.ai, a unique software application designed for entrepreneurs who want to grow their influence, impact, and income by leveraging podcast interviews, creating strategic partnerships, and connecting with media opportunities. The Guestify Platform is provided by Guestify, Inc. (“Guestify”) located at [Insert Company Address Here].
By using the Guestify Platform, you agree to these terms. Please read them carefully. Additional terms may apply, and any such terms become part of your agreement with us if you use the Guestify Platform.
Using Our Guestify Platform
You must follow any policies made available to you within the Guestify Platform.
Do not misuse the Guestify Platform. For example, do not interfere with the Guestify Platform or try to access it using a method other than the interface and instructions we provide. We may suspend or stop providing our services to you if you do not comply with our terms or policies or if we are investigating suspected misconduct.
Using the Guestify Platform does not give you ownership of any intellectual property rights in our software or the content you access. You may not use content from the Guestify Platform unless you obtain permission from Guestify or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in the Guestify Platform. Do not remove, obscure, or alter any legal notices displayed within the platform.
The Guestify Platform may display some content that is not Guestify’s property. This content is the sole responsibility of the entity that makes it available. We may review content from time to time to determine whether it violates our policies or the law, and we may remove or refuse to display content that we reasonably believe violates our policies or is otherwise objectionable.
In connection with your use of the Guestify Platform, we may send you service announcements, administrative messages, and other information. You may opt out of some of those communications.
Your Guestify Platform Account
You will need your own Guestify User Account to use all or some parts of the Guestify Platform. Guestify will provide registration access for creating your User Account. If your Guestify User Account is assigned to you by another organization (e.g., your employer or business partner), you must stop using that User Account if directed to do so by the organization.
To protect your Guestify User Account, keep your password confidential. You are responsible for activity that occurs under your account. Avoid reusing your Guestify password on third-party applications.
Privacy and Copyright Protection
By using the Guestify Platform, you agree that Guestify may use your data in accordance with our Privacy Policy.
Your Content in the Guestify Platform
The Guestify Platform allows you to upload, submit, store, share, or receive content. You retain ownership of any intellectual property rights that you hold in that content.
When you upload, submit, store, send, or receive content to or through the Guestify Platform, you grant Guestify (and those we work with) a license to use, host, store, modify, create derivative works, and distribute such content. This license is solely for the purpose of operating, promoting, and improving our services.
If you have a Guestify User Account, we may display your profile name, profile photo, and actions you take on the platform, such as displaying content and interactions.
About Guestify Platform Software
When updates to the Guestify Platform include new software, it may automatically update on your device once a new version or feature is available.
Guestify gives you a personal, royalty-free, non-assignable, and non-exclusive license to use the software provided by Guestify within the platform. This license is for the sole purpose of enabling you to use and enjoy the benefits of the platform as permitted by these terms. You may not copy, modify, distribute, sell, or lease any part of our platform or included software, nor reverse-engineer or attempt to extract the source code of that software, unless permitted by law or with Guestify’s written permission.
Modifying the Guestify Platform
We are constantly changing and improving the Guestify Platform. We may add or remove functionalities or features and may suspend or stop certain services altogether.
You can stop using the Guestify Platform at any time, though we’ll be sorry to see you go. Guestify may also stop providing services to you or add or create new limits at any time.
If we discontinue your use of the Guestify Platform, we will make reasonable efforts to provide advance notice and a chance to retrieve your data, where possible.
Our Warranties and Disclaimers
We provide the Guestify Platform with a commercially reasonable level of skill and care. However, there are certain things that we do not promise about the platform.
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, GUESTIFY AND ITS SUPPLIERS DO NOT MAKE ANY SPECIFIC PROMISES ABOUT THE PLATFORM. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT, THE SPECIFIC FUNCTIONS, OR THE PLATFORM’S RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE PLATFORM “AS IS.”
Liability for the Guestify Platform
WHEN PERMITTED BY LAW, GUESTIFY AND ITS SUPPLIERS WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES, OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF GUESTIFY AND ITS SUPPLIERS FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE PLATFORM (OR, IF WE CHOOSE, TO SUPPLYING YOU THE PLATFORM AGAIN).
IN ALL CASES, GUESTIFY AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
Business Use of the Guestify Platform
If you use the Guestify Platform on behalf of a business, you accept these terms on behalf of that business. You will hold harmless and indemnify Guestify, its affiliates, officers, agents, and employees from any claim, suit, or action arising from or related to your use of the platform or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs, and attorneys’ fees.
About These Terms
We may modify these terms or any additional terms that apply to the Guestify Platform. Changes reflecting legal updates or specific platform updates will be posted here. Changes will not apply retroactively and will become effective no sooner than seven days after posting. However, changes related to new functions or for legal reasons will be effective immediately.
These terms control the relationship between Guestify and you. They do not create third-party beneficiary rights.
If you do not comply with these terms, and we don’t act immediately, it does not mean we are giving up any rights (such as acting in the future). If a particular term is unenforceable, it will not affect any other terms.
The laws of [Your State], U.S.A., will govern any disputes arising out of or relating to these terms or the Guestify Platform. All claims will be litigated exclusively in the federal or state courts of [Your State], and you consent to personal jurisdiction in those courts.
